Welcome to Skybond. These Terms of Service (“Terms”) govern your access to and use of the Skybond mobile application, website, and related services (collectively, the “Service”) operated by Skybond (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

To use Skybond, you must:

  • Be at least 18 years of age.
  • Be a current or former aviation professional (including but not limited to pilots, cabin crew, air traffic controllers, aircraft mechanics, dispatchers, airport operations personnel, and aviation engineers).
  • Be legally permitted to use the Service under the laws of your jurisdiction.
  • Not be a person barred from receiving services under applicable law.
  • Not have been previously banned or removed from the Service.

By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and aviation credentials at any time.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use of your account.

As part of our verification process, you may be required to submit aviation credentials, including a valid work identification badge, aviation license, or certificate. Submission of fraudulent credentials will result in immediate account termination and may be reported to relevant authorities.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Harass, abuse, threaten, stalk, or intimidate any other user.
  • Post content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Submit false, misleading, or fraudulent verification credentials.
  • Solicit money, goods, or services from other users.
  • Use the Service to promote commercial activities or advertisements without our prior written consent.
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Service.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Upload viruses, malware, or other malicious code.
  • Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending or terminating accounts, and reporting to law enforcement.

5. Subscriptions and Payments

Skybond offers free and paid subscription tiers. By purchasing a subscription, you agree to the following:

  • Billing: Subscriptions are billed on a recurring basis (monthly, quarterly, or annually) at the rate displayed at the time of purchase. Payment is charged to your chosen payment method at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device's app store settings.
  • Refunds: Payments are generally non-refundable. Refund requests are handled in accordance with the policies of the Apple App Store or Google Play Store, as applicable.
  • Price Changes: We reserve the right to change subscription pricing. You will be notified of any price changes in advance, and changes will not affect your current billing period.
  • Free Trials: If offered, free trial periods automatically convert to a paid subscription unless canceled before the trial ends.

6. User Content

You retain ownership of the content you submit to the Service (photos, text, messages). By posting content, you grant Skybond a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your content solely in connection with operating and providing the Service.

You represent that you own or have the necessary rights to all content you submit, and that your content does not infringe upon the intellectual property rights of any third party.

7. Intellectual Property

The Service, including its design, logos, trademarks, text, graphics, software, and all other content created by Skybond, is the exclusive property of Skybond and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that: (a) the Service will be uninterrupted, secure, or error-free; (b) any matches or connections made through the Service will result in any particular outcome; (c) the conduct, identity, or intentions of any user are as represented.

Skybond does not conduct criminal background checks on its users. While we verify aviation credentials, you are solely responsible for your interactions with other users. We encourage you to exercise caution and use your best judgment when communicating with or meeting other users.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKYBOND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO SKYBOND IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

You may terminate your account at any time by deleting it through the app settings. We may suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason we deem appropriate.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware, United States.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Skybond.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or by sending you a notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
